Employment Decisions
The Supreme Court is winding down its term, and the justices have issued several rulings requiring employers to adjust their policies and procedures. We discuss some of those key opinions—including Muldrow v. The city of St. Louiswhich expanded the reach of Title VII—and look ahead to what’s still to come before the term ends this month.
Arbitration awards
The court took up the arbitration issue in several different decisions this term, all unanimous. For example, Smith v. to sprinkle continued the trend of Supreme Court decisions giving priority to the Federal Arbitration Law. In this case, the Court found that Section 3 of the Federal Arbitration Act requires a court to stay its proceedings pending arbitration, and the court lacks discretion to dismiss the suit.
Authority of Federal Agencies Under Review
Additional employment-related issues still need to be decided before the end of the term, including two that address the authority of federal agencies. This includes two cases challenging the 1984 Court Chevron USA, Inc. c. Natural Resources Defense Council, Inc. decision A complete return of Chevron compliance can significantly curb the authority of federal agencies.
